Price is net F.O.B. any point in the State of New York including delivery inside storeroom door. Also see "price" clause stated herein.

NOTE TO ALL CONTRACT USERS

We strongly advise all contract users to familiarize themselves with all terms and conditions before issuing a purchase order.

CONTRACT PRICING CONDITIONS

Pricing for all items shall include shipping, handling, insurance and associated delivery charges. Title and risk of loss passes from the vendor to the purchaser upon delivery and/or installation (see Section 65 of the General Specifications).

All products shall come with one (1) copy of full documentation as defined below and shall be covered by a minimum 90-day guarantee.

Price additional for Full Support as defined under System Support and Maintenance is also listed.

If substantially the same or a smaller quantity of a commodity is sold by the contractor under the same or similar terms and conditions as that of any State contract for such commodity then held by the contractor, at a price lower than the State contract price, the price to the State shall be immediately reduced to the lower price. When any price reductions occur, they should immediately be reduced to the State even if delays occur in processing the paperwork.

ALTERNATE AFFILIATIONS

Some eligible users have affiliations with outside associations (ex.: AASHTO - American Association of State Highway and Transportation Officials, etc.) which would make that entity eligible for additional discounts. The State reserves the right to allow those users to buy from this award and still receive the benefit of any additional discounts for which they are eligible.

In addition, any such purchases will be credited to the accumulated purchase level for this contract.
